Terms of Service

EverKeep is an organizational tool that helps you record information about your insurance policies and share it with people you choose. EverKeep is not an insurance company, broker, or law firm. We do not sell insurance, give legal advice, or guarantee outcomes related to your policies.

• You must be at least 18 years old to create an account.
• You're responsible for keeping your password secure and for activity that happens under your account.
• You're responsible for the accuracy of the information you enter.
• Notify us promptly if you suspect unauthorized access at support@geteverkeep.com.

You agree not to:

• Use EverKeep for any unlawful purpose.
• Upload information that isn't yours or that you don't have permission to share.
• Attempt to interfere with the security or operation of the service.
• Use EverKeep to impersonate someone else.

You retain ownership of everything you upload or enter into EverKeep. You grant us a limited license to store, process, and display that content solely to operate the service for you and the people you invite.

Certain features of EverKeep — including EverKeep for Agents — require a paid subscription. By subscribing, you agree to the following:

• Pricing. EverKeep for Agents is billed at $29 USD per month, charged in advance on a recurring basis. Prices may change with at least 30 days' notice emailed to you before the change takes effect.
• Payment processor. Payments are processed by Stripe, Inc. ("Stripe"). When you subscribe you also agree to Stripe's terms — see Stripe's Services Agreement. EverKeep does not see or store your full card number.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period until canceled.
• Cancellation. You can cancel anytime from your account billing settings or by emailing support@geteverkeep.com. Cancellation takes effect at the end of the current billing period; you keep access until then.
• Refunds. See our Refund Policy.
• Taxes. Prices are exclusive of any applicable taxes; where required, applicable taxes will be added at checkout.
• Failed payments. If a payment fails, we may retry the charge and suspend paid features until the outstanding amount is paid.

EverKeep is provided "as is". We do not warrant that:

• The service will be uninterrupted or error-free.
• The information you store will always be accessible.
• Beneficiaries or other invitees will act on the information you share with them.
• EverKeep is a substitute for a will, estate plan, or consultation with a licensed professional.

You should keep your own backups of critical documents.

To the maximum extent permitted by law, EverKeep is not liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or goodwill arising out of your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim (or USD 50, whichever is greater).

You can delete your account at any time. We may suspend or terminate your access if you violate these Terms or use EverKeep in a way that risks harm to other users or to the service. If we terminate your account for cause, sections 4–8 survive.

We may update these Terms from time to time. If we make material changes, we'll notify you by email or in the app before the changes take effect. Continued use after the effective date means you accept the updated Terms.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware.
